NO FCRA USE. This privately owned website is not connected with a local, New Mexico, or federal government body. Neither the site nor an advertising partner offers a service for credit decisions, employment screening, insurance underwriting, tenant screening, or another purpose regulated by the Fair Credit Reporting Act (FCRA). Its function is to identify criminal-record resources for De Baca County and New Mexico. It is not a consumer reporting agency or private investigation firm.
1. What This Website Is
This is a private reference site with no government affiliation. It does not keep official criminal records, retrieve files, conduct official background checks, or submit documents on a visitor's behalf.
Its content identifies the De Baca County Sheriff's Office, criminal courts, NMDPS Law Enforcement Records Bureau, and New Mexico DPS Sex Offender Registry as possible custodians, along with outside research tools. Public-office access is governed by laws including the New Mexico Inspection of Public Records Act, Sections 14-2-1 through 14-2-12 NMSA 1978. Arrest-record dissemination is separately controlled by the Arrest Record Information Act, Sections 29-10-1 through 29-10-8 NMSA 1978.
2. Rules for Using This Site
Use is conditioned on an agreement not to:
- Use a bot, scraper, or other automated means against the pages
- Interfere with performance or another visitor's access
- Attempt unauthorized entry into any system or restricted area
- Rely on site content for housing, hiring, credit, or insurance decisions
- Stalk, threaten, or harass a person using information found here
- Violate any applicable local, state, or federal law
3. No Harassment, Stalking, or Discrimination
Information obtained here or through a linked tool may not be used to intimidate, stalk, harass, threaten, or discriminate against anyone. Such conduct is forbidden and may violate criminal or civil law. New Mexico's Sex Offender Registration and Notification Act, Sections 29-11A-1 et seq. NMSA 1978, and registry notices set strict boundaries on use of New Mexico DPS Sex Offender Registry data. The registry serves public safety awareness. It cannot lawfully support vigilantism, workplace blacklisting, or housing discrimination.
4. We Are Not a Consumer Reporting Agency
This site is not a consumer reporting agency under the FCRA and does not create a background check, credit report, or consumer report. Its advertising partners likewise do not offer services designed to evaluate applicants, renters, insurance risk, or credit. Information from the site or a linked tool must not be used to:
- Make any other decision governed by the FCRA
- Set insurance terms or assess creditworthiness
- Determine eligibility for a permit, license, or government benefit
- Evaluate a rental or housing application
- Make an employment decision
A check required for a regulated purpose must be obtained through an authorized official process or a compliant consumer reporting agency, as the governing law requires. NMDPS LERB does not provide an unrestricted public name-search portal.
5. No Legal Advice
The content is general information, not legal advice. It cannot determine how a De Baca County charge, warrant, conviction, or New Mexico expungement provision applies to a specific set of facts. Obtain advice from a licensed New Mexico attorney.
6. No Warranties
All site content and functions are supplied "as is." No warranty is made that:
- An outside search provider's results will be complete or correct
- The pages contain no bug, error, or security weakness
- The service will always remain available without interruption
- Published information is complete, accurate, or current
Criminal records can change when a charge is filed or dismissed, a disposition is entered, or an expungement order limits public access. Updates may not appear here at once. Nothing published on the site is an official statement by a sheriff, court, NMDPS, or another government office.
7. Third-Party Services and Links
Links may lead to law enforcement pages, court portals, New Mexico agencies, legal-aid organizations, and independent search services. Those destinations are not controlled by this site. We are not responsible for their accuracy, availability, fees, content, or data practices. Review the destination's terms before using it.
8. Intellectual Property
De Baca County Criminal History or its content partners own the site's text, code, logos, and graphics. No one may reproduce, distribute, adapt, or create a derivative work from that material without prior written permission.
9. Limits on Our Liability
To the greatest extent permitted by law, we disclaim liability for damages arising from site use, including reliance on content found here or through an outside service.
10. Indemnification
You agree to indemnify and hold us harmless from claims, demands, or proceedings caused by your use of the site or violation of these terms, including related legal fees and costs.
11. Governing Law
New Mexico law governs these terms. Any dispute arising from use of the site must be brought in a court located in New Mexico.
12. Changes to These Terms
These terms may be revised at any time. A revised version becomes effective when it is posted on this page.
13. Cutting Off Access
Access may be restricted or ended at any time, for any reason, without advance notice.
14. Severability
If a court finds one provision invalid or unenforceable, all remaining provisions continue in force. The affected language will be limited only as far as needed to make it enforceable.
15. Questions
Questions about these conditions may be submitted through the Contact page.
